Employer liability and group cover: what solves what?

Among business owners, the most common misunderstanding about group accident insurance sounds like this: "so that takes care of the workplace-accident issue." It doesn't – and whoever tells you that honestly is doing you a favour. The two systems solve different things; together, they're strong.

In short:
  • After a workplace accident, the employer's liability for damages can exist under the law – group accident insurance doesn't replace this.
  • Group cover eases the situation: the employee gets a payout with no investigation into fault, and the edge comes off any disputes.
  • Handling the liability side is the domain of employer liability insurance – the territory of felelosseg.biz (in Hungarian).

The liability side: what does the law say?

Under employment-law rules, an employer can carry broad liability for damages arising from accidents connected with the employment relationship – the details (the extent of liability, the grounds for exemption) depend on the legislation in force and the circumstances of the case. This liability is matched to the employee's ACTUAL LOSS: lost income, costs, compensation for the injury itself – with no upper limit. This is exactly the risk employer liability insurance is for – a separate line of cover with its own logic: we write about it in detail on felelosseg.biz (in Hungarian).

Group accident cover: what does it add?

Group accident insurance doesn't settle the question of liability – it settles the employee's situation: it pays the contracted fixed amounts, quickly, with no investigation into fault, through the standard claim-notification route. This eases the situation in three ways: the injured person's family gets breathing room; the "I need to get something" tension isn't channelled straight into legal action; and the company is in a caring role, not a defensive one. In practical terms: group cover is the trust capital, liability insurance is the legal and financial shield.

Why don't they replace each other?

Because they're matched to different things. Group accident cover pays the CONTRACTED amounts – regardless of the actual size of the loss or the question of liability. A claim for damages is matched to the ACTUAL loss – and a group payout doesn't, on its own, extinguish that claim (whether it's offset depends on the case and the rules in force – that's a matter for lawyers). So if you think you've "dealt with" the topic with a group policy, your liability side is still open; if you only carry liability insurance, your employee is missing that help. The two together, sized to your company, cover both sides.

The to-do list for business owners

Four steps. One: keep your workplace-accident administration in order – records, reporting, in line with the rules. Two: group accident cover – simple to roll out. Three: assess your liability risk – it depends on your activities, along the felelosseg.biz line. Four: one joint review a year – headcount, activities, amounts. We can go through all four at one table – the consultation is free of charge.
